TENNIS EXPRESS #SMASHTHAT Contest OFFICIAL RULES
NO PURCHASE NECESSARY. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. THE CONTEST IS INTENDED FOR PLAY IN THE UNITED STATES. DO NOT ENTER THIS CONTEST IF YOU ARE LOCATED OUTSIDE THE UNITED STATES. Tennis Express, LP is the Sponsor of the Contest. Entrants will have the opportunity to win a Trip for Two in March 2017 to Miami, FL to watch the pros play.
ELIGIBILITY: The TENNIS EXPRESS #SMASHTHAT CONTEST (the “Contest”) is open only to residents of the fifty (50) United States (including the District of Columbia), who are 18 years of age or older at the time of entry. Employees of Tennis Express, LP, and their respective partners, affiliates, vendors and competitors, as well as the immediate family members (spouse, parents, siblings and children) and household members of each such employee, are not eligible. Void where prohibited or restricted by law. Contest is subject to all applicable federal, state, and local laws and regulations. By entering, you agree to these Official Rules and the decisions of Sponsor, which are final and binding in all respects. Winning a prize is contingent on fulfilling all requirements set forth herein.
CONTEST PERIOD: The #SMASHTHAT Contest begins at 5 p.m. Eastern Time (“ET”) on Friday, June 3, 2016 and ends at 11:59 p.m. ET on September 30, 2016.
HOW TO ENTER: To enter and have a chance to win, post a video of your interpretation of #SMASHTHAT to Facebook, Instagram, Twitter, or Google+. Tag Tennis Express on Facebook, @Tennis_Express on Instagram, @TennisExpress on Twitter, and @TennisExpress on Google+. We encourage multiple entries per contestant. Be sure to share with your friends and get them involved! Get creative! NO PURCHASE NECESSARY.
WINNER NOTIFICATION: Once all of the videos have been submitted, the winning submission will be chosen by the contest committee. The winner will be chosen based on creativity, entertainment value, and stylistic flare. Winner will be notified via social media. If winner notification remains unanswered for more than forty-eight (48) hours, the prize will be forfeited in its entirety. The prize is not transferable; no prize substitutions or cash alternatives are allowed except as may be determined by Sponsor in its sole discretion.
PRIZE AND RETAIL VALUE: Grand Prize trip to Miami, FL in March 2017 is valued at $3,000. Includes Airfare for 2 from a major city in the continental USA to Miami, Florida along with a 3 night hotel stay and tickets for two people for 2 sessions to the Miami Tournament. Prize Winner will be responsible for all other expenses including food and local transportation. Only 1 Grand Prize will be awarded. All federal, state, and local taxes and fees are the sole responsibility of the winner. Sponsor will comply with all income tax reporting obligations. Grand Prize has no cash value and cannot be exchange for cash.
BY ENTERING THE CONTEST, participants release and hold harmless Sponsor, and their respective partners, subsidiaries, affiliates, directors, officers, employees, and agents from any and all liability for any injuries, loss, or damage of any kind arising from or in connection with this Contest or any prize won, including any injuries, loss or damage of any kind arising from or in connection with participation in the Contest. Content submitted to #SMASHTHAT Contest becomes the property of Tennis Express for future use and distribution. Sponsor is not responsible for any typographical or other error in the printing of this offer, administration of the Contest or in the announcement of prizes. In the event Sponsor is prevented from continuing with this Contest, or the Contest is undermined by any event or other cause not reasonably within Sponsor’s control (each a “Force Majeure” event or occurrence), Sponsor shall have the right, in its sole discretion, to abbreviate, modify, suspend, cancel, or terminate the Contest without further obligation and, if so, Sponsor reserves the right, but not the obligation, to award the prize from among all valid and eligible entries received up to the time of such Force Majeure event. All entries are the property of Sponsor and are not returnable. The laws of the state of Texas (USA), without regard to its conflict of law rules, will govern these Terms. Any action relating to this Contest shall be initiated only in the state and federal courts located in Harris County, Texas (USA).
ONLINE REGISTRATION: This Contest is intended for viewing in the United States only and shall be construed and evaluated according to U.S. law. Do not enter this Contest if you are not located in the 50 United States or District of Columbia or if you are not a legal U.S. resident. Entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. In the event of a dispute, the potential winner may be required to provide proof that he/she is the authorized account holder of the identified email account, and Sponsor’s decision will be final. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries, including any error that may result in an erroneous appearance of qualification for a prize. Sponsor is not responsible for any problem or technical malfunction of any computer equipment or software that results in loss of entry. WARNING: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY COMPUTERIZED SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGE FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
